Refunds & Cancellations
1. Introduction
This Refund and Cancellation Policy (“Policy”) explains how Akivva handles payments, cancellations, and refund requests made by users (“Subscribers” and “Creators”).
Because Akivva operates as a membership-based digital platform where payments provide instant access to creator content, all transactions are treated as final unless specific conditions apply.
By subscribing to or using Akivva, you agree to this Policy and to the Terms of Service.
2. Nature of Transactions
Akivva facilitates recurring monthly payments from Subscribers to Creators through Stripe.
When a Subscriber joins a Creator’s page or membership tier, the payment grants immediate access to digital content for the duration of the paid period.
Akivva acts as an intermediary, processing payments and distributing earnings to Creators after applicable fees and taxes.
3. Refund Eligibility
Payments made through Akivva are non-refundable, except in the following circumstances:

Unauthorized Transactions: If your payment method was used without your consent.

Duplicate Charges: If a technical error results in multiple identical transactions.

System Errors: If Akivva’s platform experiences a technical failure preventing access to content.
In all other cases (including dissatisfaction with a Creator’s content or changes in membership), payments are considered final.
4. Requesting a Refund
Refund requests must be submitted within 7 days of the original transaction date.
To request a refund, please contact us at [email protected] with the following information:

Your Akivva account email.

The date and amount of the transaction.

The reason for your refund request.
Each case is reviewed individually, and approval is at the discretion of Akivva’s support team.
If a refund is approved, it will be processed through Stripe back to the original payment method.
5. Subscription Cancellations
Subscribers can cancel their memberships at any time through their Account Settings page.
When you cancel:

Your subscription remains active until the end of the current billing cycle.

No further payments will be charged unless you re-subscribe.

You will retain access to content for the remaining paid period.
Creators may also remove content or close their pages at any time, which does not entitle Subscribers to refunds unless covered by Section 3.
6. Creator Earnings and Refund Adjustments
When a refund is issued, the amount may be deducted from the Creator’s pending balance.
If the refunded payment has already been paid out, Akivva may offset the amount against future Creator payouts.
Creators are responsible for maintaining accurate payment details and monitoring transactions within their dashboards.
7. Chargebacks and Disputes
Initiating a chargeback with your bank or credit card provider before contacting Akivva may result in account suspension.
We encourage users to resolve disputes directly through [email protected].
Akivva reserves the right to contest fraudulent or unfounded chargebacks and to share relevant transaction data with Stripe and financial institutions to protect against misuse.
8. Responsibility of Creators
Creators acknowledge and agree that:

Refunds may affect their earnings and future payouts.

They must comply with Akivva’s content and payment policies.

Repeated refund or chargeback patterns may result in account review or termination.
9. Legal Basis and Compliance
This Policy complies with applicable consumer protection laws in the United States, as well as the EU Directive on Consumer Rights for digital services.
Under these laws, digital goods and services that are delivered immediately after payment are typically not subject to mandatory refunds, unless they are defective or unavailable.
10. Limitation of Liability
Akivva and Nefter LLC are not responsible for:

Losses caused by user errors, forgotten cancellations, or dissatisfaction with digital content.

Bank or card issuer delays in refund processing.
-
Reimbursement for third-party fees (e.g., currency exchange or cross-border charges).
Our total liability is limited as described in the Terms of Service.
11. Updates to This Policy
Akivva may update this Policy periodically to reflect changes in law, platform structure, or payment providers.
Material updates will be announced via email or platform notice, and the “Effective Date” at the top of this document will be revised accordingly.
